Elimination of Flash Order Exception From Rule 602 of Regulation NMS

The Securities and Exchange Commission proposes to amend Rule 602 of Regulation NMS to eliminate the exception allowing equity and options exchanges to exclude flash orders from consolidated quotation data. If adopted, the amendment would require exchanges to include flash orders with nonmarketable prices in the consolidated data and prohibit the display of marketable flash orders by applying Rule 610(d) restrictions on locking or crossing quotations. The Commission also proposes to apply Rule 301(b) of Regulation ATS consistently to alternative trading systems regarding the use of flash orders. Comments on the proposed rule are due by November 23, 2009.
