The Commission extends previously granted exemptions to the American Stock Exchange LLC (Amex) under Rule 608(e) of the Securities Exchange Act of 1934, effective February 6, 2007, through the established Trading Phase Date. These exemptions relieve Amex from specific trade-through provisions of the ITS Plan regarding intermarket sweep orders and the obligation to route orders through the ITS electronic communications network. Concurrently, the Division of Market Regulation staff extends the period during which it will not recommend enforcement action against Amex for failing to enforce compliance with Amex Rule 236 concerning ISOs and private linkages. Both the Commission's exemptions and the staff's no-action position are subject to modification or revocation at any time if deemed necessary to further the purposes of the Act.
