Final Report on RTS for CCP Admission Criteria and NFC Clearing Member Assessment

The European Securities and Markets Authority (ESMA) has finalized draft Regulatory Technical Standards specifying the elements central counterparties must consider when establishing admission criteria for clearing members. These standards implement amendments to EMIR Article 37 introduced by EMIR 3, requiring non-discriminatory, transparent, and objective access while ensuring members possess sufficient financial resources and operational capacity. The framework specifically addresses the assessment of non-financial counterparties' ability to meet margin and default fund contributions, including provisions for sponsored models and client clearing services.
