Order Sunsetting Certain Large Trader Reporting Requirements for Physical Commodity Swaps

The Commodity Futures Trading Commission renders the routine daily and event-based position-reporting requirements of 17 CFR Part 20 ineffective and unenforceable for clearing organizations, clearing members, and swap dealers. This action eliminates the obligation to file large trader reports for physical commodity swaps, as the Commission determines that swap data repositories now provide sufficient data for market surveillance. The Commission retains the authority to require the maintenance and production of underlying books, records, and futures-equivalent conversion methods upon special call under retained sections 20.6 and 20.5(b). This Order becomes effective on July 21, 2026.
