Political Contributions by Certain Investment Advisers

Proposed rule 206(4)-5 prohibits an investment adviser from providing compensated advisory services to a government client for two years after the adviser, its partners, executive officers, or solicitors make a political contribution to state treasurers, comptrollers, or other elected officials who can influence the selection of the adviser. The prohibition excludes contributions of $250 or less to officials for whom the contributor can vote and also bars services while soliciting contributions for such officials. Registered advisers with government clients must maintain records of political contributions and solicitation activities by these covered persons.
