Private Fund Advisers; Documentation of Registered Investment Adviser Compliance Reviews
The Securities and Exchange Commission is adopting technical amendments to the Code of Federal Regulations to reflect the vacatur of the Private Fund Adviser Rules by the U.S. Court of Appeals for the Fifth Circuit. These amendments rescind the new rules and corresponding amendments to the Advisers Act books and records and compliance rules that were previously adopted in August 2023. The changes remove specific regulatory sections and revise existing provisions to align with the court's June 2024 decision, ensuring the CFR accurately represents the current legal status of these requirements.
