disclosure
privacy

The Securities and Exchange Commission adopts Regulation S-AM to implement Section 624 of the Fair Credit Reporting Act, prohibiting covered persons from using eligibility information received from an affiliate to make marketing solicitations unless the consumer receives notice and a reasonable opportunity to opt out. The rules apply to brokers, dealers, investment companies, registered investment advisers, and registered transfer agents, requiring that opt-out notices be delivered electronically or in writing rather than orally. Compliance with these requirements becomes mandatory as of January 1, 2010, following an effective date of September 10, 2009.
