Rule 15c3-3 Reserve Requirements for Margin Related to Security Futures Products

The Securities and Exchange Commission proposes amendments to Rule 15c3-3a to allow broker-dealers to include customer security futures product margin deposited with a Clearing Agency or Derivatives Clearing Organization as a debit item in their Reserve Formula calculations. This treatment is permitted only if the Clearing Agency or Derivatives Clearing Organization maintains the highest investment-grade rating from a nationally recognized statistical rating organization, or holds security deposits of at least $500 million and assessment power of at least $1.5 billion. Additionally, the margin must be deposited in a bank with written certification that no lien can be placed on it, and the entity must maintain specific safeguarding systems and fidelity bond coverage. Broker-dealers using a Derivatives Clearing Organization not registered with the Commission must obtain an undertaking allowing Commission examination for compliance with these conditions.
