SEC Division of Investment Management staff letter: Securities Industry and Financial Markets Association

The Division of Investment Management extends a temporary no-action position regarding compliance with Markets in Financial Instruments Directive II (MiFID II) research provisions until July 3, 2023. During this extended period, the staff will not recommend enforcement action to the Commission if a broker-dealer provides research services constituting investment advice under section 202(a)(11) of the Advisers Act to an investment manager required by MiFID II to pay for such services. The staff will not consider such a broker-dealer to be an investment adviser during the Extended Period, provided the facts and representations from the original October 26, 2017 letter remain applicable.
