SEC Division of Market Regulation no-action letter: Extension of the Exemption from the Order Protection Provisions of the Intermarket Trading System ("ITS") Plan with Respect to Single-Priced Closing Transactions

The Division of Market Regulation extends the previously granted exemptions to the New York Stock Exchange LLC (NYSE) from certain trade-through provisions of the Intermarket Trading System (ITS) Plan, specifically Sections 8(d)(i), 8(d)(ii), and Exhibit B, as well as NYSE Rule 15A, with respect to single-priced closing transactions. This extension applies to the period from February 6, 2007, up to the Trading Phase Date for Regulation NMS, which was established as March 5, 2007. The staff of the Division will not recommend enforcement action to the Commission under Section 19(g)(1) of the Act if NYSE does not enforce compliance with these provisions during this extended period. These exemptions are subject to modification or revocation at any time if the Commission determines such action is necessary or appropriate to further the purposes of the Act.
