SEC Division of Trading and Markets no-action letter: AdvisorShares Madrona & Meidell ETFs

The Division of Trading and Markets will not recommend enforcement action if broker-dealers treat shares of the Meidell Tactical Advantage ETF and Madrona Forward Global Bond ETF as shares of a Qualifying ETF under the November 21, 2005 Class Relief Letter for purposes of Section 11(d)(1) of the Securities Exchange Act of 1934 and Rules 10b-10, 11d1-2, 15c1-5, and 15c1-6. This relief applies provided the Funds do not hold securities from a single issuer in excess of 20% of portfolio holdings, except for government securities during temporary defensive positions. The Division also states it will no longer respond to requests for relief from these provisions for new ETFs of ETFs unless they present novel or unusual issues.
