The SEC staff determines that a member sending an order for its own account coupled with a customer order to trade ahead of other trading interest participates in the execution of the transaction under Rule 11a2-2(T). Consequently, such members may not rely on Rule 11a2-2(T) for an exemption from the Section 11(a)(1) prohibition of the Securities Exchange Act of 1934. This restriction applies to members trading with their own customers through exchange facilities where the member's order trades in whole or in part with the customer's order.
