Securities and Futures (OTC Derivative Transactions – Reporting and Record Keeping Obligations) Rules

2 files · 61 PDF pages

Authorized Institutions, AMBs, and LCs must report OTC derivative transactions to the HKMA via the HKTR on a T+2 basis. Entities with outstanding notional amounts exceeding US$30 million or those becoming regulated more than six months after the specification day lose concession periods and must report immediately. Reporting requires HKTR membership, successful user tests, and submission of standard templates containing mandatory data fields and a unique transaction identifier. Subsequent events and errors must also be reported via the HKTR, with the reporting obligation remaining with the entity even if an agent is used.
