Segregation of Assets Held as Collateral in Uncleared Swap Transactions

The Commodity Futures Trading Commission issued final rules amending regulations to simplify requirements for swap dealers and major swap participants regarding the segregation of initial margin for uncleared swaps. The amendments streamline counterparty notification procedures, eliminate prescriptive custodian identification and cost disclosure mandates, and remove restrictions on the investment of segregated assets. These changes aim to reduce regulatory burdens and increase flexibility while maintaining protections for counterparties under the Commodity Exchange Act.
