Regulation SHO and Rule 10a-1

The Securities and Exchange Commission removes Rule 10a-1 and adds Rule 201 to Regulation SHO, prohibiting any price test, including those of self-regulatory organizations, from applying to short sales in any security. The Commission also amends Rule 200(g) of Regulation SHO to eliminate the requirement that broker-dealers mark sell orders of equity securities as 'short exempt' when relying on an exception from a price test. These final rules become effective on July 3, 2007, with a compliance date of July 6, 2007.
