2014-02-20 | CFTC Staff Letter 14-18Added · Updated
The CFTC Divisions will not recommend enforcement action against Southwest Power Pool, Inc., its members, and market participants who meet the Appropriate Persons Requirement for failing to comply with certain Commodity Exchange Act provisions regarding Pre-Launch Activities and Subject Transactions. This relief applies to transactions offered under the FERC-approved tariff and is effective immediately, expiring on August 31, 2014, or upon final Commission action on the Exemption Application, whichever occurs first. The exemption excludes the general anti-fraud and anti-manipulation authority and scienter-based prohibitions defined as Enforcement Provisions.
