Commission Delegated Regulation (EU) 2023/2779 on criteria for identifying shadow banking entities

The European Commission adopted Delegated Regulation (EU) 2023/2779 to specify regulatory technical standards for identifying shadow banking entities under Article 394(2) of Regulation (EU) No 575/2013. Institutions must classify money market funds, alternative investment funds with substantial leverage, and entities performing banking services without Union authorization as shadow banking entities. The regulation explicitly excludes authorized financial institutions, entities excluded from specific EU directives, non-financial group credit intermediaries, and third-country entities supervised under Basel Core Principles. This regulation entered into force on the twentieth day following its publication in the Official Journal of the European Union.
