Exemptions From Swap Trade Execution Requirement

The Commodity Futures Trading Commission adopted a final rule establishing two exemptions from the statutory requirement to execute certain swaps on a swap execution facility or designated contract market. The first exemption applies to swaps that qualify for an exception or exemption from the clearing requirement under Commission regulation part 50. The second exemption codifies prior relief for swaps entered into by eligible affiliate counterparties that are cleared, regardless of whether the affiliates claim the inter-affiliate clearing exemption.
