The Commodity Futures Trading Commission issued a final rule amending Part 49 regulations to implement the Fixing America’s Surface Transportation Act by removing the indemnification requirement for swap data access. The amendments establish new procedures for Swap Data Repositories to grant access to swap data held by domestic and foreign regulators upon execution of confidentiality arrangements. The rule also updates definitions, clarifies jurisdictional scope, and sets compliance dates for the revised regulatory framework.
