Mandatory Electronic Submission of Applications for Orders Under the Investment Company Act and Filings Made Pursuant to Regulation E

The Securities and Exchange Commission amends Regulation S-T and Investment Company Act Rule 0-2 to require the mandatory electronic submission of applications for orders under any section of the Investment Company Act and Regulation E filings by small business investment companies and business development companies on the EDGAR system. The amendments eliminate the temporary hardship exemption for submitting Investment Company Act applications and remove requirements for notarizing certain accompanying documents and submitting draft notices as exhibits. These rules become effective on January 1, 2009.
