Regulation of Exchanges and Alternative Trading Systems

The Securities and Exchange Commission adopts new rules and amendments to allow alternative trading systems to choose registration as national securities exchanges or as broker-dealers under Regulation ATS based on their activities and trading volume. The Commission repeals Rule 17a–23, transferring recordkeeping requirements to Rules 17a–3 and 17a–4 for broker-dealer internal trading systems, and excludes certain pilot trading systems operated by self-regulatory organizations from rule filing requirements. These rules become effective on April 21, 1999, with specific provisions regarding market transparency and execution access fees for certain securities becoming effective on April 1, 2000.
