First Trust Exchange-Traded Fund IV requests exemptive and no-action relief from Rule 14e-5 under the Securities Exchange Act of 1934 for its actively managed First Trust North American Energy Infrastructure Fund. The relief permits the fund to issue and redeem shares in Creation Units of 50,000 shares through Authorized Participants while allowing those participants to engage in short sales and other trading activities that would otherwise violate the rule. The fund operates as a non-diversified open-end management investment company listed on the NYSE Arca, Inc., with a transparent portfolio designed to facilitate arbitrage activity similar to index-based ETFs.
