SEC Division of Investment Management staff letter: Australian Securities Commission

The Securities Act of 1933 requires mutual funds to deliver a statutory prospectus to investors prior to or with confirmation of a sale, including for additional purchases by existing shareholders. Funds may satisfy this obligation for subsequent purchases by delivering an updated statutory prospectus on an annual basis, provided the prospectus is current at the time of the purchase. If the previously delivered prospectus is not current when an additional purchase is made, the fund must deliver a copy of the latest prospectus before or at the time of that purchase.
