The Head of the Economic Department (Depec) and the Head of the Financial System Monitoring Department (Desig), using the powers granted by Article 22, item I, letter “a” of the Internal Regulations of the Central Bank of Brazil (BCB), annexed to Ordinance No. 29,971 of March 4, 2005, in accordance with Article 15 of Circular No. 3,567 of December 12, 2011,
R E S O L V E:
Art. 1. The procedures to be observed in the submission of information to the Credit Information System (SCR), as provided for in Circular No. 3,567 of December 12, 2011, are amended.
Art. 2. The provision of information to the SCR, as provided for in Article 1 of Circular No. 3,567 of 2011, must be carried out:
I - by the institutions mentioned in items II, III, V to VIII, XV, and XVI of Article 4 of Resolution No. 3,658 of December 17, 2008, regarding information of a specific nature of credit operations carried out: through the document with code 2211 – Aggregated Daily Data of Credit Operations;
II - by all institutions mentioned in Article 4 of Resolution No. 3,658 of 2008, regarding:
a) supplementary customer data: through the document with code 3026 – Individualized Supplementary Credit Risk Data;
b) all credit operations carried out: through the document with code 3040 – Credit Risk Data;
III - by the institutions mentioned in items II to VIII, X, XIII, XV to XVII of Article 4 of Resolution No. 3,658 of 2008, regarding information of a specific nature of credit operations carried out: through the document with code 3050 - Aggregated Credit and Financial Leasing Statistics.
§ 1. The document with code 2211, of daily periodicity, must be submitted by the fifth business day following the respective base date.
§ 2. The document with code 3026, of annual periodicity, whose base date is December, must be submitted by June 30 of the year following the respective base date.
§ 3. The document with code 3040, of monthly periodicity, whose balance to be reported corresponds to that existing on the last day of the month, must be submitted by the 10th (tenth) business day of the month following the respective base date.
§ 4. The document with code 3050, with daily information grouped weekly, must be submitted by the fifth business day following the respective base date.
§ 5. Corrections to the document with code 3040 must be made regarding the values corresponding, at most, to the base dates of the 13 (thirteen) months prior to the current month.
Art. 3. The documents referred to in Article 2 must be:
I - sent to Desig:
a) according to the coding of the Document Catalog (Cadoc), presented in the annex to this Circular Letter;
b) through the PSTAW10 application (information exchange), as provided for in Circular Letter No. 2,847 of April 13, 1999, available for download on the BCB website at http://www.bcb.gov.br/htms/pstaw10.asp;
II - prepared:
a) in TXT format, when related to the document referred to in item I of Article 2;
b) in XML format (eXtensible Markup Language), when related to the documents referred to in items II and III of Article 2;
III - validated, before their submission, using the XSD validation scheme (XML Schema Definition), with the exception of documents with codes 2211 and 3040; and
IV - submitted to the validator application, available on the BCB website at http://www.bcb.gov.br/?SCR, when related to the document with code 3040.
Art. 4. For the purpose of submitting the documents referred to in Article 2, the models, layouts, filling instructions, example files, XSD validation schemes, validator program, and SCR manuals must be used, observing the version available on the BCB website at http://www.bcb.gov.br/?SCR.
Sole paragraph. Version updates of the SCR elements referred to in the caput of this article will be informed through the issuance of specific regulations.
Art. 5. The information regarding the average term and levels of delay of operations, to be provided through the document with code 2211, must be updated only on the base date representing the last business day of the month.
Sole paragraph. The delay levels referred to in this article must be classified in the following ranges:
I - no delay or delay of up to 14 days;
II - delay between 15 and 30 days;
III - delay between 31 and 90 days;
IV - delay exceeding 90 days.
Art. 6. For the purposes of Article 1, item II, and §§ 1 and 2 of Circular No. 3,567 of 2011, regarding credit operations provided individually, the set of customer operations, for the formation of the document with code 3040, is considered the amount of active operations, operations written off as losses, co-obligations, and guarantees provided to the customer and interbank transfers, excluding from the calculation credits contracted to be disbursed and unconditional and unilateral non-cancellable credit commitments.
Art. 7. In addition to the information contained in the document with code 3026, the following information may be requested, upon request, through the document with code 3025 – Customers Requested by the Central Bank of Brazil:
I - balance sheet data regarding:
a) the three social years prior to the base date of the request; or
b) the last available balance sheet relative to the year prior to the base date of the request, when the balance sheet relative to December 31 of the year prior to the base date of the request is unavailable; and
II - risk classification assigned by a rating agency, type of classification, and agency, if the institution uses this information in its risk assessment processes.
Art. 8. Information regarding credit operations for which judicial elimination of their registration in the SCR has been determined must continue to be sent for base dates subsequent to that stated in the judicial decision, as established in the system manuals, observing that compliance with the judicial decision will be verified automatically, as registered by the institution.
Art. 9. In addition to the provisions of Article 8 of Circular No. 3,567 of 2011, the registration in the SCR of the following credit operations must be carried out:
I - by the present value of the installments provided in the contracts, including the guaranteed residual value, paid in advance or not, obtained by using the internal rate of return of each of them, as per Circular No. 1,429 of January 20, 1989, in the case of financial financial leasing operations;
II - by the present value of the installments provided in the contracts, obtained in the manner provided for in Article 6, § 2, of the Regulation Annexed to Resolution No. 2,309 of August 28, 1996, with the wording given by Article 1 of Resolution No. 2,465 of February 19, 1998, in the case of operational financial leasing operations;
III - by the value of invoices due for the purchase of goods and services, by the amount financed to the customer due to non-payment of the invoice at maturity, payment restricted to the minimum value indicated on the invoice, installment payment with or without interest, and cash withdrawals, plus revenues and charges of any nature earned, in the case of operations resulting from the use of credit cards;
IV - by the amount advanced or financed to the customer, plus revenues and charges of any nature earned, in operations of Advance on Exchange Contracts (ACC), Advance on Delivered Exchange (ACE), and other advances in national currency;
V - by the amount advanced or financed to the customer, plus revenues and charges of any nature earned, including the exchange rate variation calculated during the period, in import financing operations and advances in foreign currencies.
Art. 10. For the purposes of Article 3 of Circular No. 3,567 of 2011, the following information must be registered in the SCR:
I - operations that have been negotiated with an intervenor or assignor not constituted as one of the institutions mentioned in Article 4 of Resolution No. 3,658 of 2008;
II - credit operations that have been the subject of negotiation between the institutions mentioned in Article 4 of Resolution No. 3,658 of 2008;
III - credit operations negotiated between the institutions mentioned in Article 4 of Resolution No. 3,658 of 2008 and investment funds in credit rights, with substantial retention of risks and benefits through the acquisition of shares of these funds;
IV - credit operations that have been the subject of negotiation with institutions not mentioned in Article 4 of Resolution No. 3,658 of 2008, with substantial retention of risks and benefits or control, as per Resolution No. 3,533 of January 31, 2008.
Art. 11. Information regarding the statements of disagreement referred to in item III of Article 7 of Resolution No. 3,658 of 2008 must be provided to the SCR, as established in the SCR manuals.
Art. 12. The information of the document with code 3050 must be calculated:
I - on the base date representing the last business day of the reference month, for operations carried out:
a) with directed resources; or
b) with free resources, in the following modalities:
1 - real estate financing;
2 - rural credit;
3 - credit card - cash purchases; or
4 - other free credits; and
II - daily, for other operations.
Art. 13. The information of the document with code 2211 must be sent until the base date of August 31, 2012, inclusive, from which its submission will be discontinued.
Art. 14. The base dates from which the respective documents:
I - will not be sent, in the case of null balances being calculated in all credit operation modalities; or
II - must be sent, in the case of the institution starting to present a positive balance in any of the responsibilities mentioned in Article 3 of Resolution No. 3,658 of 2008, so that its reception is authorized,
may be registered with Desig, for the document with code 2211, through the PMSG750 transaction of the Central Bank Information System (Sisbacen), and for the document with code 3040, through the SCR functionality.
Art. 15. The PESP930 transaction of Sisbacen may be used to register:
I - the base date from which the document with code 3050 will not be sent, in the case of null balances being calculated in all credit operation modalities;
II - the submission of the document with code 3050 only in the manner of item I of Article 12, given the exclusive carrying out of the credit operations mentioned therein.
Art. 16. The PESP930 transaction of Sisbacen must be used to register:
I - the base date from which the document with code 3050 must be sent, in the case of the institution starting to present a positive balance in any of the credit operation modalities, so that its reception is authorized;
II - the base date from which the institution will no longer exclusively carry out the credit operations mentioned in item I of Article 12.
Art. 17. Credit operations reported individually to the SCR, in accordance with Article 1, item II, of Circular No. 3,567 of 2011, cannot have the following data altered until they have been settled, negotiated without substantial retention of risks and benefits or control, as per Resolution No. 3,533 of 2008, or removed from the system as per Article 8, item III, of Resolution No. 3,658 of 2008:
I - customer identification;
II - modality and submodality; and
III - contract code.
§ 1. The renegotiation of credit operations must be reported to the SCR, according to the guidelines contained in the filling instructions and manuals referred to in Article 4 of this Circular Letter, allowing, in this case, the alteration of the data mentioned in items II and III of this article.
§ 2. The alteration of the contract code of the assigned portion of the operation is admitted for operations that have been the subject of partial assignment, provided that the new code is formed by using the original contract code, with this positioned at the beginning.
Art. 18. Financial institutions and other institutions for which the extrajudicial liquidation regime has been decreed are exempt from sending the document with code 3050, from the date of the decree of this regime.
Art. 19. Any doubts should be sent via e-mail to the electronic address scr.gestao@bcb.gov.br, filling in the subject field with the expression "SCR - Detailed, Aggregated, and Supplementary Information on Credit", when related to the submission of documents with codes 3026, 3040, 3045, and 3046, or with the expression “Aggregated Credit and Financial Leasing Statistics”, when related to the submission of documents with codes 2211 and 3050.
Art. 20. This Circular Letter enters into force on the date of its publication.
Art. 21. Circular Letters No. 3,517 of July 27, 2011, and No. 3,527 of December 22, 2011, are revoked.
