Custody of Investment Company Assets Outside the United States

The Securities and Exchange Commission amends rule 17f-5 under the Investment Company Act of 1940 to provide registered management investment companies with greater flexibility in managing foreign custody arrangements. The amendments eliminate capital requirements for eligible foreign custodians, replacing them with a standard requiring that fund assets be subject to reasonable care based on factors such as the custodian's financial strength and internal controls. Additionally, the rule removes the requirement for annual board approval of foreign custody arrangements and permits the delegation of custodian selection and monitoring duties to the fund's investment adviser, officers, or a bank. These changes become effective on June 16, 1997.
